'''Competition policy''' is the set of laws and institutions that aim to maintain competition in markets and to prevent conduct that harms consumers and reduces economic efficiency. It encompasses the prohibition of anticompetitive agreements, the control of mergers, and the regulation of the conduct of dominant firms.

== Objectives ==
The objectives of competition policy include the promotion of consumer welfare, the protection of the competitive process, and the efficient allocation of resources. The policy seeks to prevent firms from exercising market power, whether through collusion, through mergers, or through exclusionary conduct.

The formulation of objectives varies across jurisdictions. Some emphasise consumer welfare, measured by prices and quality, while others include broader goals such as the protection of small businesses, the promotion of innovation, and the preservation of economic opportunity.

== Instruments ==
Competition policy operates through several instruments. The prohibition of anticompetitive agreements targets cartels and other forms of collusion. Merger control reviews transactions that would substantially lessen competition and may block or impose conditions on them. The regulation of dominance addresses conduct by firms with substantial market power, including exclusionary practices and abuses.

Each instrument involves assessment of market definition, of competitive effects, and of possible efficiencies. The analysis draws on economics, including the theory of industrial organisation, and it requires evidence on market structure, conduct, and performance.

== Enforcement ==
Enforcement involves investigation, adjudication, and the imposition of remedies. Authorities can impose fines, order the cessation of conduct, and require divestitures. Private damages actions provide an additional channel through which competition law is enforced.

The design of enforcement balances deterrence against the costs of investigation and the risk of deterring procompetitive conduct. The use of leniency programmes, commitments, and settlements has enhanced the effectiveness of enforcement in many jurisdictions.

== Debates ==
Competition policy is the subject of continuing debate. Questions concern the appropriate standard for evaluating mergers, the treatment of efficiencies, the role of non-price effects, and the adaptation of policy to digital markets, where network effects, data, and platforms raise new issues.

The debate also concerns the relationship between competition policy and other policies, including industrial policy and regulation. The balance between general competition enforcement and sector-specific regulation varies across jurisdictions and over time, reflecting differences in legal traditions and in economic circumstances.

== Merger Control ==
Merger control reviews transactions that could substantially lessen competition. The analysis defines the relevant market, assesses the competitive effects of the transaction, and considers possible efficiencies and remedies.

The standard for intervention varies across jurisdictions. Some use a dominance test, prohibiting mergers that create or strengthen a dominant position, while others use a substantial lessening of competition test. The choice of standard affects the scope of intervention.

== Abuse of Dominance ==
The regulation of dominance addresses conduct by firms with substantial market power. Prohibited conduct includes exclusionary practices, such as predatory pricing and exclusive dealing, and exploitative practices, such as excessive pricing.

The assessment of dominance involves the definition of the market, the measurement of market power, and the analysis of the effects of the conduct. The framework seeks to distinguish between legitimate competition and conduct that harms consumers and the competitive process.

== Digital Markets ==
Competition policy in digital markets faces new challenges. Network effects, economies of scale, and data advantages can entrench incumbents and create barriers to entry. Platform business models raise questions about self-preferencing, interoperability, and access to data.

The response includes the adaptation of existing frameworks, the development of new tools, and the introduction of ex ante regulation for large platforms. The design of these measures balances the benefits of intervention against the risks of impeding innovation.

== International Dimensions ==
Competition policy has international dimensions, since markets are global and firms operate across borders. The differences among national regimes create challenges for enforcement and for the assessment of transactions with cross-border effects.

Cooperation among authorities, through networks and bilateral agreements, facilitates the exchange of information and the coordination of enforcement. The design of international cooperation addresses the challenges of different legal frameworks and of the allocation of cases.
